Beauty services look lightly regulated — until you notice that salons touch municipal licensing, state-specific spa/massage regulations, cosmetic product law, hygiene inspection regimes and (for spas particularly) police-permission layers born of decades of misuse. The stack differs sharply between a neighbourhood salon and a full-service spa. Here is both maps, and the operating disciplines inspectors actually check.
The salon base stack
- Municipal trade licence — salons/beauty parlours are scheduled trades in every corporation; annual renewals
- Shops & Establishment registration; GST past ₹20 lakh (services at 18%)
- Fire compliance per premises size; building-use legitimacy for commercial operation
- Product side: retail of cosmetics needs no licence, but products used/sold must themselves be licensed cosmetics (verify supplier licences) — spurious-product raids target salons as the point of use
- Staffing formalities as you grow: PF/ESI thresholds, and written employment terms for a churn-prone industry
Spas and massage: the state-permission layer
Cross from haircuts into massage/spa therapy and several states add a regime: registration/licensing of spas and massage centres under state rules or police-act provisions — commonly requiring police NOCs/verification of operators and therapists, gender-segregation and signage norms, therapist rosters with ID records, restrictions on cabin locks/opaque doors per local rules, and operating-hour limits. Metro police commissionerates publish spa-licensing conditions; violating them is what triggers the raids the industry knows too well. Legitimate wellness operators should treat this layer as their moat: full compliance, documented therapist credentials (recognised therapy certifications), and CCTV-at-common-areas per rules make your establishment inspection-proof while the grey market absorbs enforcement.
Hygiene: the inspectable disciplines
- Sterilisation of tools (autoclave/UV cabinets with logs) — the single most-checked item; disposable razors/blades per client
- Towel and linen hygiene: per-client changes, documented laundry cycles
- Chemical safety: patch tests for colour/keratin services (documented), MSDS awareness for strong treatments, ventilation in chemical zones
- Waste: sharps and chemical waste handled responsibly; some municipalities apply bio-waste-style expectations to salons
- Staff health and grooming standards on record
Allergic reactions to colour and treatments are the industry's commonest consumer complaint and negligence claim. A signed patch-test/consent record per chemical service — two minutes of process — defeats ninety per cent of them. Make it software-enforced at billing.
Services at the medical boundary
The growth end of beauty keeps touching medicine: laser hair reduction, chemical peels beyond cosmetic grades, microneedling, slimming machines, IV 'drips'. The regulatory line: procedures that are medical require medical supervision — dermatologist-led protocols, medical-grade device compliance, and in several states, clinical-establishment registration for medi-spa services. Aggressive marketing of medical outcomes ('permanent', 'clinical results') without that structure invites both medical-council complaints and consumer litigation. Decide which side of the line each menu item lives on, and staff/paper it accordingly.
GST, packages and consumer terms
Services bill at 18%; retail product sales at their goods rates — separate line items keep books clean. Package prepayments trigger GST on receipt and consumer-law duties on redemption: honour validity fairly, state transfer/refund rules at sale, and track redemptions in software (unredeemed-package disputes are the sector's consumer-forum staple). Membership models add the same disciplines as gyms. Franchised salons: verify the franchisor's trademark and product-supply compliance flows into your unit's paperwork.
